Advertisement agreement & disclaimer
1. Introduction
Clarksville.Live ("Service Provider") agrees to provide advertising services to the undersigned ("Advertiser") under the following terms and conditions.
2. Advertising Content
All advertising content must be family-friendly and appropriate. The Advertiser must provide proof of ownership or legal responsibility to represent the small business being advertised before being approved including proof of identity. We also refuse and are absolutely not liable for any/all responsibilities concerning inaccuracies within the business ad.
Here are some examples of what advertisers could provide as proof of ownership or legal responsibility to represent their small business:
1. **Business License or Registration**: A valid business license or certificate of registration issued by a government authority.
2. **Articles of Incorporation**: Official documents filed with a government agency that establish a company's legal status.
3. **Trademark or Copyright Documentation**: Proof of ownership of trademarks, logos, or any other intellectual property associated with the business.
4. **Legal Contracts or Agreements**: Contracts or agreements that show the advertiser has the authority to act on behalf of the business.
5. **Proof of Identity**: Identification documents of the business owner(s) or representative(s), such as a driver's license or passport.
6. **Tax Identification Number**: A document showing the business's tax identification number (TIN) or employer identification number (EIN).
7. **Utility Bills or Lease Agreements**: Documents that verify the business’s physical address, like utility bills or lease agreements.
3. Advertising Placement
All advertising on our YouTube and Live-Map is free. However, the placement of advertisements is not guaranteed, and the Service Provider reserves the right to post or remove any advertisement at will, without explanation. Advertisers may only have one advertisement per platform up at a time.
4. Content Standards
Advertisements must meet the Service Provider's content standards and may be presented according to the Service Provider's standards and discretion.
5. Rejection and Removal
The Service Provider reserves the right to reject or remove any advertisement for any reason, without explanation.
6. Liability and Representation
The Advertiser represents and warrants that they are the owner or legally responsible representative of the small business being advertised, and that they have the right to submit advertisements on behalf of the business.
7. Termination
The Advertiser may request the removal of their advertisement at any time by contacting the Service Provider via Discord or e-mail.
8. Privacy & Data Security
• The Service Provider will only collect and store information necessary for business verification. No personal financial data or sensitive business operations details will be stored.
• Advertiser information will not be shared, sold, or disclosed to third parties except as required by law.
• Advertisers understand that data security measures are in place, but they assume responsibility for any risks related to submitting verification documents.
9. Truthful Advertising & Legal Compliance
• Advertisers must ensure that all submitted content is truthful, accurate, and not misleading per Federal Trade Commission (FTC) advertising regulations.
• Advertisements must not infringe on trademarks, copyrights, or intellectual property belonging to other businesses or individuals.
• The Service Provider is not responsible for verifying claims made in advertisements but reserves the right to remove any ad suspected of deception.
10. Electronic Marketing & Communications
• Advertisers providing email addresses must adhere to CAN-SPAM Act regulations if their ads involve promotional messaging.
• The Service Provider will not use Advertiser contact information for unsolicited marketing.
We may also edit, change, and/or remove anything from this policy at any time.
